Tribunal Upholds Fayemi’s Election As Ekiti Governor

The Ekiti State election tribunal has dismissed the petition of the Peoples Democratic Party and its candidate in the Ekiti governorship election for lacking in merit.

The tribunal upheld and affirmed the election of Mr Kayode Fayemi as the duly elected governor of the State.

Chairman of the Tribunal Sulaiman Belgore held that the petitioner failed to prove allegations of improper procedure and accreditation, intentional voiding of votes, harassment and violence during the election.

The tribunal also held that it failed to prove that governor Kayode Fayemi was not qualified to participate in the election on the strength of his indictment by a commission of enquiry in Ekiti state.

According to the tribunal, the indictment of a person is no longer a part of the Nigerian law following the first alteration of the constitution in 2010.

The tribunal held that the totality of evidence and arguments show no evidence of bad incidence substantial enough to show that election was marred. If any of such had happened there is no evidence before the court.

The tribunal also held that there are two thousand polling units in Ekiti state and there were complaints in about one thousand units and of those 1000 only 71 witnesses were invited of the 900 witnesses that the petitioner said will be called to testify and their testimony is not substantial enough to show that any infraction enough to hold that did not take place in Ekiti state in accordance with the law.

It was also stated that the witnesses were not witnesses of truth or competent enough for the court to uphold the petition of the petitioner.

The tribunal held that the petitioner failed to prove beyond resealable doubt that governor Fayemi was voted by the majority of lawfully casted votes as such the petition in totality lacks merit and is hereby dismissed.

The tribunal held that it has no reason to upturn the decision by INEC to return Mr Kayode Fayemi as the duly elected governor of Ekiti state.
